2. Scope

This policy explains what personal data Media Process collects, why it is processed, the legal grounds for the processing, with whom it may be shared, how long it is retained and how you can exercise your rights.

It applies in particular when you visit the website, request a quotation, contact Media Process, place an order, subscribe to the newsletter or communicate with customer service.

3. Data collected

Depending on your interaction with Media Process, the following categories of data may be processed:

• Identification and contact data: name, first name, company, position, postal address, email address and telephone number;
• Professional and administrative data: company or VAT number, billing details and information required to prepare a quotation or fulfil an order;
• Request and order data: the content of your message, project specifications, files submitted, communication history, quotations, orders, invoices and payment information;
• Communication and marketing data: newsletter subscription, preferences, consent records, unsubscribes and interactions with communications;
• Technical data: IP address, browser and device type, operating system, security logs, pages viewed and information collected through cookies or similar technologies, depending on your choices.

Fields marked as mandatory in a form are required to process your request. If you do not complete them, Media Process may be unable to respond, prepare a quotation or provide the requested service.

4. Purposes and legal grounds

Media Process processes your data for the following purposes and on the following legal grounds:

• Responding to contact and quotation requests: steps taken at your request before entering into a contract and, depending on the context, the legitimate interest in responding to business enquiries;
• Managing orders, production, delivery, invoicing and after-sales service: performance of a contract;
• Maintaining accounts and complying with tax, administrative and regulatory obligations: compliance with a legal obligation;
• Securing the website and its forms and preventing fraud, abuse and spam: Media Process’s legitimate interest in protecting its systems and communications;
• Improving the website, its services and the visitor experience: legitimate interest or consent where consent is required for the relevant cookies or technologies;
• Sending newsletters and marketing communications: consent where required, or legitimate interest within the legally permitted limits for existing customers;
• Establishing, exercising or defending legal claims and managing disputes: legitimate interest.

5. Form protection using Cloudflare Turnstile

Media Process uses Cloudflare Turnstile, a service provided by Cloudflare, to protect its forms against automated submissions, fraud, abuse and spam.

For this purpose, Turnstile may process technical information such as the IP address, browser and device characteristics, and certain signals relating to interaction with the website to determine whether a request is likely to originate from a person or an automated program. This verification is based on Media Process’s legitimate interest in securing its website and forms. According to Cloudflare, Turnstile does not access the content of the fields you complete in the form as part of this verification.

6. Recipients and service providers

Your data is accessible only to Media Process staff members who need it to perform their duties. To the extent necessary, it may also be disclosed to the following categories of recipients:

• hosting, IT maintenance and security providers;
• email, form, newsletter and audience analytics providers;
• Cloudflare for Turnstile form protection;
• service providers involved in the production, delivery or fulfilment of an order;
• professional advisers, accountants, insurers and legal counsel;
• public or judicial authorities where required by law.

These recipients receive only the data required for their task and must process it confidentially and securely.

7. Transfers outside the European Economic Area

Some technical service providers may process data from a country outside the European Economic Area. Where this occurs, Media Process ensures that the transfer relies on a mechanism recognised by the GDPR, such as an adequacy decision, the European Commission’s Standard Contractual Clauses or another appropriate safeguard.

8. Retention periods

Media Process retains data only for as long as necessary for the relevant purpose, subject to legal obligations and the need to defend its rights. As a general rule:

• contact and quotation requests that do not lead to a business relationship are retained for three years after the last relevant contact;
• customer and order data is retained throughout the contractual relationship and subsequently for the applicable statutory limitation periods;
• accounting and tax documents are retained for the period required by applicable law, generally ten years;
• data used for marketing is retained until consent is withdrawn or an objection is made, and no longer than three years after the last active contact for prospective customers;
• newsletter data is retained until unsubscribing or until it is no longer necessary;
• technical and security logs are retained for a period proportionate to security and investigation needs;
• cookie retention periods are specified in the Cookie Policy.

9. Security

Media Process implements reasonable technical and organisational measures to protect personal data against loss, alteration, unauthorised access, accidental disclosure and any other unlawful processing. Access to personal data is limited to those persons and service providers who require it to perform their duties.

As no method of electronic transmission or storage can guarantee absolute security, Media Process regularly adapts its measures to identified risks and evolving practices.

10. Your rights

Subject to the conditions set out in the GDPR, you may exercise the following rights:

• the right to access your data and obtain a copy;
• the right to rectify inaccurate or incomplete data;
• the right to erasure in the circumstances provided by law;
• the right to restrict processing;
• the right to object, in particular to direct marketing;
• the right to data portability where applicable;
• the right to withdraw your consent at any time, without affecting the lawfulness of previous processing;
• the right to lodge a complaint with a supervisory authority.

If there is reasonable doubt about your identity, Media Process may request only the additional information strictly necessary to verify it. A copy of your identity card will not be required systematically. If a copy is necessary, irrelevant information may be concealed.

You may also lodge a complaint with the Belgian Data Protection Authority, Rue de la Presse 35, 1000 Brussels.

11. Intellectual property

Unless otherwise stated, the text, graphics, photographs, logos, trademarks and other content on this website are protected by intellectual property rights and belong to Media Process or are used with the permission of their respective owners. Any unauthorised reproduction, adaptation, distribution or exploitation is prohibited, except as permitted by law.

12. External links and liability

Media Process endeavours to provide information that is as accurate and up to date as possible, but cannot guarantee that all content is entirely free from errors or continuously updated. The website may contain links to third-party websites over which Media Process has no control. Media Process is not responsible for the content or privacy practices of those external websites.
